What Does A Last Will & Testament Cover?
A Last Will & Testament is a binding document that allows for you to control how your assets will be distributed after your death. A Will is valid in Arizona if it is signed by the decedent and signed by two witnesses. It is important to understand that the Will does not allow your beneficiaries to bypass the probate process. Some of the items that a Last Will & Testament will cover include:
- Determining how your assets will be distributed.
- Nominating guardians for dependent children.
- Nominate a personal representative (Executor)
- List beneficiaries of the estate
Do It Yourself vs Hiring A Legal Team To Draft A Last Will & Testament
There are many options online that allow you to use templated last will and testament documents. Although this may seem like a cost effective solution, the ultimate cost of doing your last will on your own will be significant. A template last will can result in your wishes being contested after being incapacitated or after passing away. These contested estate cases tend to get ugly and cause a lot of pain to everyone involved.
Ultimately, you don’t know what you don’t know. Having a conversation with an experienced estate planning attorney will help you determine exactly what your estate plan needs to look like and will take the stress off of your shoulders when it comes to developing your last will. Our legal team offers free consultations to help you start the will development process.
