Is a Holographic Will Valid In Arizona?
Arizona does in fact recognize handwritten / holographic wills.
Although a handwritten will is recognized by the state of Arizona, that does not mean it should be the path you take for your will. There are many mistakes that can occur in a handwritten will that can lead to it being contested due to failure to comply with statutory requirements and due to the language being unclear.
Cautioning Against Relying On A Hand Written Will
People who are considering relying on a handwritten will tend to do so because it is the easiest path forward for planning their estate. Although it may seem like the easiest path, it is the most problematic path. Handwritten wills are more likely to be contested in court which can cause a lot of stress for the family and can be very time consuming.
There are many options available to you to plan your estate and to make sure your assets are passed on to your beneficiaries in a seamless and timely manner. It is important to have a consultation with an experienced attorney to help you navigate your estate planning and help you put together the best plan for you and your family.
